Alcohol Sales Information 

Conditions for third party listings of alcohol on the Buy Kiwi Website

 

1. Buy Kiwi Limited (BKL) does not itself transact alcohol: The Website operates only as a ‘platform’ for the sale and purchase of alcohol between two parties (i.e.. BKL provides an online space for purchasers to connect with merchants and enter into transactions to buy alcohol– but BKL itself does not provide alcohol or receive sale funds).

2. Merchants require off-licenses: Merchants selling alcohol on the Website must obtain off-licenses (for ‘remote sales’) under the Sale and Supply of Alcohol Act 2012 (‘Sale of Alcohol Act’).  We note that such alcohol licenses may include conditions – including the appointment of a duty manager.

3. Controls on display and sale:  BKL enables Merchants to do the following: 

    1. display a picture of the Merchant’s license in a prominent and relevant place on the Website that clearly shows the Merchant’s license-holder’s name, license number, and license expiry date (practically, these could be displayed on the same page as any listing for alcohol); 
    2. include the above Merchant license details are in included in every receipt for alcohol sold via the Website; 
    3. have Website visitors confirm that they are over 18 when they visit a page relevant to the sale of the alcohol (using a check-box or by entering their date of birth); 
    4. have Website visitors confirm they are over 18 again before they complete a purchase of alcohol (again using a check-box or by entering their date of birth); 
    5. not selling alcohol to any people unless, during both of the steps above, they confirm they are over 18 years of age; and 
    6. ensure that alcohol is not delivered to purchasers on certain days (e.g. Good Friday), nor during certain times (between 11pm – 6am);

4. Responsible promotion: BKL itself does not do any of the following (which are offences under the Sale of Alcohol Act):

    1. encourage people to consume alcohol in excess; 
    2. promote or advertise discounts on alcohol as being at 25% or more; 
    3. promote or advertises alcohol as being ‘free’; 
    4. offer anything (including the opportunity to win a prize) on the condition that alcohol is purchased; nor 
    5. promote or advertise alcohol in way that may have special appeal to people under the age of 18 (including high levels of alcohol advertising on social media).
